• your breach of our Terms of Service or of applicable law, including privacy, consumer protection and intellectual property law;
• any failure to obtain the consents required in your state or territory for call recording, monitoring or customer communications;
• content or data you submit to or transmit through our services, including any claim that it infringes a third party's rights;
• any third-party claim arising from your deployment of PeakBot on your phone line, website or other channel; and
• any reliance by you or a third party on AI output as professional or regulated advice.

To the maximum extent permitted by law, our total aggregate liability for all claims connected with our services is limited to the fees you paid us in the three (3) months before the event giving rise to the claim, or one hundred Australian dollars (AUD $100) if you have not yet paid us any fees.

We are not liable for indirect or consequential loss, including loss of revenue, profits, business, goodwill or data, business interruption, reputational damage, or loss arising from the inherent limitations of AI technology such as inaccuracies and hallucinations.

These exclusions and the indemnity above survive the end of your use of our services.

Nothing on this page excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
